Terms of Service

These Terms of Service govern your use of iShaper, a surfboard design application operated by Ryan Kotzebue.

1. Acceptance of Terms

By accessing or using iShaper, you agree to these Terms. If you do not agree, do not use the service.

2. Who May Use iShaper

You may use iShaper only if you can form a legally binding agreement with me and your use complies with applicable law. The service is not intended for children under 13 because U.S. children's privacy rules place special requirements on services like this. If you're a younger grom who wants to shape boards, ask a parent or guardian to create the account and use iShaper with you.

3. Accounts and Access

iShaper currently uses Google sign-in for account access. You are responsible for your account activity and for keeping access to your Google account secure.

Access to boards is organized around a workspace or organization. If you are invited into or create an organization, your ability to view or manage content depends on the permissions associated with that organization.

4. Subscriptions and Billing

Some features may require a paid subscription. Billing is handled through Stripe, not directly by me. If you purchase a subscription, you authorize the applicable charges and any recurring charges you select through Stripe.

Pricing, features, and availability may change over time. If billing is enabled for your organization, subscription management and payment updates are handled through Stripe's checkout and billing portal flows.

5. Your Content

You retain ownership of the content you create in iShaper, including board names, notes, design snapshots, published versions, and related workspace content.

You give me a limited license to host, store, reproduce, process, adapt, display, and transmit your content only as needed to operate, maintain, secure, improve, export, and provide sharing or collaboration features for the service.

6. Public Boards and Remixes

If you mark a board as public, it may appear in public areas of the service and may be accessible to others through share links, public rack pages, and printed QR-linked pages.

Public boards may also be remixed by other signed-in users. A remix creates a copy of the selected public version in another user's workspace. If you do not want that behavior, keep the board private.

7. Acceptable Use

You agree not to:

  • use iShaper in violation of law or another person's rights;
  • attempt to interfere with the service, its security, or other users;
  • upload or share content you do not have the right to use or publish;
  • use the service to distribute malware, spam, or abusive material;
  • copy, scrape, or reverse engineer the service except as allowed by law.

8. Changes, Suspension, and Termination

I may update, modify, pause, or discontinue all or part of iShaper at any time. I may also suspend or terminate access if I reasonably believe your use violates these Terms, creates risk for the service, or could harm other users.

You may stop using iShaper at any time. If you want to request account or data deletion, contact hello@ishaper.surf.

9. No Warranty

iShaper is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, I disclaim warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, I will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, goodwill, data, or business interruption arising out of or related to your use of iShaper.

To the maximum extent permitted by law, my total liability for any claim arising out of or relating to iShaper will not exceed the amount you paid, if any, to use the service during the 12 months before the event giving rise to the claim.

11. Updates to These Terms

I may update these Terms from time to time. If I make a material change, I may update the effective date above and take other reasonable steps to notify users when appropriate. Your continued use of iShaper after an update means the revised Terms apply.
